Dans ce d\u00e9lai, votre proche est lib\u00e9r\u00e9 ou conduit devant un juge d&rsquo;instruction (onderzoeksrechter). La loi ne donne pas \u00e0 la famille le droit de rendre visite \u00e0 votre proche pendant ces 48 premi\u00e8res heures.<\/p>\n<p>Une personne priv\u00e9e de libert\u00e9 a notamment ces droits :<\/p>\n<ul>\n<li>une concertation confidentielle avec un avocat avant la premi\u00e8re audition, en principe de 30 minutes ;<\/li>\n<li>l&rsquo;assistance de cet avocat pendant l&rsquo;audition ;<\/li>\n<li>une assistance m\u00e9dicale ;<\/li>\n<li>le droit de faire pr\u00e9venir une personne de son choix.<\/li>\n<\/ul>\n<p>Ce dernier droit explique pourquoi vous \u00eates parfois inform\u00e9 tard.<\/p>\n<p>Le procureur du Roi ou le juge d&rsquo;instruction peut retarder cet avertissement par une d\u00e9cision motiv\u00e9e. Ce n&rsquo;est possible que si l&rsquo;enqu\u00eate ou la s\u00e9curit\u00e9 d&rsquo;une personne l&rsquo;exige de mani\u00e8re urgente.<\/p>\n<p>En Flandre, l&rsquo;audition se d\u00e9roule en n\u00e9erlandais. Si votre proche ne comprend pas le n\u00e9erlandais, un interpr\u00e8te est appel\u00e9, sans frais pour lui.<\/p>\n<h2 id=\"arrestation-administrative-ou-judiciaire-la-difference\">Arrestation administrative ou judiciaire : la diff\u00e9rence<\/h2>\n<p>Une arrestation administrative r\u00e9tablit l&rsquo;ordre public et dure au maximum 12 heures. L&rsquo;heure de l&rsquo;arrestation d\u00e9termine par exemple quand le d\u00e9lai de 48 heures expire.<\/p>\n<h3 id=\"etape-2-demandez-ou-se-trouve-votre-proche\">\u00c9tape 2 : Demandez o\u00f9 se trouve votre proche<\/h3>\n<p>Vous pouvez contacter la zone de police et demander o\u00f9 votre proche est retenu.<\/p>\n<p>Ce que vous apprenez d\u00e9pend de l&rsquo;enqu\u00eate. Peu d&rsquo;informations n&rsquo;est pas en soi un mauvais signe : la police ne peut pas tout communiquer.<\/p>\n<h3 id=\"etape-3-contactez-un-avocat-pour-la-suite\">\u00c9tape 3 : Contactez un avocat pour la suite<\/h3>\n<p>Votre proche peut choisir un avocat. La police \u00e9tablit le contact via la permanence des barreaux, qui d\u00e9signe aussi un avocat si votre proche n&rsquo;en conna\u00eet pas.<\/p>\n<p>Si votre proche est ensuite pr\u00e9sent\u00e9 au juge d&rsquo;instruction, cette audition est le prochain moment important.<\/p>\n<p>Un avocat qui suit le dossier d\u00e8s le d\u00e9but peut mieux pr\u00e9parer ce moment.<\/p>\n<p>La proc\u00e9dure en Flandre se d\u00e9roule en n\u00e9erlandais.<\/p>\n<h3 id=\"etape-4-rassemblez-les-informations-pratiques\">\u00c9tape 4 : Rassemblez les informations pratiques<\/h3>\n<p>Pr\u00e9parez d\u00e9j\u00e0 ce que l&rsquo;avocat peut utiliser :<\/p>\n<ul>\n<li>l&rsquo;adresse o\u00f9 votre proche habite ;<\/li>\n<li>des informations sur son travail, ses \u00e9tudes ou sa famille ;<\/li>\n<li>des informations m\u00e9dicales, comme un traitement ou un m\u00e9decin traitant.<\/li>\n<\/ul>\n<p>Si votre proche prend un m\u00e9dicament chaque jour, signalez-le \u00e0 la police.<\/p>\n<p>Ces informations montrent aussi qu&rsquo;une personne a une adresse fixe et une vie stable. Cela compte quand un juge d\u00e9cide d&rsquo;une remise en libert\u00e9.<\/p>\n<h2 id=\"ce-qu-il-vaut-mieux-ne-pas-faire\">Ce qu&rsquo;il vaut mieux ne pas faire<\/h2>\n<p>Ne parlez pas des faits par t\u00e9l\u00e9phone, par message ou sur les r\u00e9seaux sociaux, et ne contactez ni les t\u00e9moins ni les victimes possibles.<\/p>\n<p>Un tel contact peut \u00eatre mal compris.<\/p>\n<p>Le risque qu&rsquo;une personne se concerte avec d&rsquo;autres ou fasse dispara\u00eetre des preuves est l&rsquo;un des motifs d&rsquo;une d\u00e9tention.<\/p>\n<p>Laissez en place les objets qui pourraient concerner l&rsquo;enqu\u00eate.<\/p>\n<p>Ne partagez pas non plus de photos ou de messages sur l&rsquo;arrestation en ligne. Ce qui a \u00e9t\u00e9 partag\u00e9 ne peut plus \u00eatre repris.<\/p>\n<h2 id=\"apres-48-heures-liberation-ou-juge-d-instruction\">Apr\u00e8s 48 heures : lib\u00e9ration ou juge d&rsquo;instruction<\/h2>\n<p>Apr\u00e8s 48 heures au maximum, votre proche est libre, ou le juge d&rsquo;instruction a d\u00e9cid\u00e9 d&rsquo;un mandat d&rsquo;arr\u00eat (aanhoudingsbevel) ou d&rsquo;une libert\u00e9 sous conditions.<\/p>\n<p>Une lib\u00e9ration ne signifie pas que l&rsquo;affaire est termin\u00e9e. L&rsquo;enqu\u00eate peut continuer et mener plus tard \u00e0 une convocation.
